Terms and Conditions of Advertising with www.eclipsemagazine.co.uk
Your order will be acknowledged via email within 48 hours.
Classified advertisements placed using this contract will appear in electronic format on the websites www.eclipsemagazine.co.uk or www.shopfortheraces.co.uk for the confirmed defined period.
Where the period is open-ended, the advertiser is required to give 30-days notice in writing (email is acceptable providing confirmation of receipt is received by return email) regarding the cessation of the contract.
Advertisements will appear in the section of the website specified in the invoice and will contain a hyperlink back to the advertiser’s own website.
Advertorials (on www.eclipsemagazine.co.uk) will be edited and presented in the style of the editorial content on the website, and will contain a hyperlink back to the advertiser’s own website. They will display a badge ‘Advertorial’ or equivalent, to differentiate advertorials from editorial, as per legal requirement.
Blogs produced by advertisers will carry the information ‘Sponsored’, ‘Guest Blog’, ‘Guest Blogger’ or ‘Guest Post’ to show they are paid for, but will be subject to editorial direction, assessment and editing before publication, as per all non-paid for blogs. This content may be inserted into the body of the article, or in the author biog below it.
Advertorials will remain on either website for the period of membership/period of time specified on the invoice; they will be removed when membership ceases or at the advertiser’s request.
The editor reserves the right to refuse to publish advertorials deemed not suitable for publication or not suitable for the readers of www.eclipsemagazine.co.uk and www.shopfortheraces.co.uk. In the event of an unsuitable advertorial, the advertiser will be invited to adjust and resubmit their advertorial, and the same terms and conditions will apply as per the original invitation.
Other Products will remain on the website as per the invoice issued.
Your contract will be fulfilled by Eclipse Magazine Limited, a company registered in England and Wales under registered number 6176942 whose registered office is at Brook Villa, Willington Lane, Clotton, CW6 0HQ together with its agents and sub-contractors. Contact Number 07706 716907.
When the contract is formed
When your payment details are confirmed through our secure online booking system, you are making an offer to order a classified advertisement or advertisements that, if accepted by us, will result in a binding contract.
We reserve the right not to accept or process your order for any reason. All orders are subject to validation checks and authorisation by your payment card issuer. If we do not accept your order and your credit/debit card has already been debited, we will notify you and refund your card in full immediately.
Right to refuse orders
We reserve the right not to fulfil and to cancel orders for any reason, including but not exclusive to:
• If we are unable to obtain payment for the order
• If the advertisement(s) is deemed by Eclipse Magazine Ltd to be unsuitable for display in the public domain or not suitable for the classifieds section on www.eclipsemagazine.co.uk
Cancellations and Refunds
Once an order is placed we offer no-questions-asked refunds to all customers within seven days of your Banner, Advertorial, Product Placement or Competition going live (less an administration fee of £50).
Prices quoted include taxes (where applicable).
Prices are in UK sterling (GBP). If ordering from overseas (non-UK) addresses the amount charged to your credit card will be according to the exchange rates or currency options in force with our secure transaction partner PayPal.
Credit Card or Direct Debit Payment
By entering your payment details into our secure online payment system you are confirming that you are aged 18 or over and are the credit/debit card or account holder.
Our liability to you in the event of an advertisement not appearing on the website for the defined period shall, at our discretion, be limited either to rescheduling of the advertisement’s appearance or refund of the cost of the advertisement.
To the extent permitted by law we exclude all other liability to you. Our exclusions of liability shall not apply to any damages arising from death or personal injury caused by our negligence or that of any of our employees or agents.
These Terms and Conditions do not and shall not affect your statutory rights as a consumer.
Third Party Rights
A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them.
Use of Personal Information
We use the personal and transactional information (e.g. name, address, e-mail address, credit card or account details) (‘Personal Information’) you supply to us in order to fulfil your advertisement order.
Unauthorised access to personal information
Unless a member of our staff has been fraudulent or negligent, we will not be liable to you for any losses you may suffer as a result of unauthorised access by a third party to the information (including in particular PayPal account details) you transmit when you place an order. It is your responsibility to ensure the security of your own PayPal account details to avoid unauthorised use.
We may change these Terms and Conditions at any time upon giving you 10 days prior written notice.
Governing Law and Jurisdiction
These Terms and Conditions are governed by English law. You hereby irrevocably submit to the exclusive jurisdiction of the English courts notwithstanding the jurisdiction where you are based.
These Terms and Conditions override any contrary terms or conditions published by us in relation to any order placed by you with us.
Copyright of Photographs and text
Advertisers are responsible for obtaining copyright clearance for the publication of photographs and text.
Advertisers warrant that all photographs and text are licenced and available for publication without further fee.
Advertisers hereby indemnify Eclipse Magazine Ltd in relation to any claims of copyright in relations to such photographs or text.
